By booking travel services with Embark Cruises, LLC ("we," "our," "us"), you ("customer," "you," "your") agree to the following Terms and Conditions:

1. General Acknowledgment

All bookings made through our website, CRM, or directly with our travel advisors are subject to the terms set forth here, along with any supplier terms and conditions provided by cruise lines, airlines, hotels, insurance providers, and other travel vendors.

2. Pricing and Availability

All pricing is subject to change at any time due to supplier promotions, inventory availability, or pricing adjustments. Quoted prices are not guaranteed until a deposit is paid and the booking is confirmed by the travel supplier. Embark Cruises, LLC is not responsible for price changes that occur prior to deposit or confirmation.

3. Accuracy of Information

You are responsible for providing accurate passenger details, including full legal names, dates of birth, and payment information. Any costs resulting from incorrect information provided by you are your responsibility.

4. Payment and Refunds

Payments are processed through secure, PCI-compliant systems. Refunds, when applicable, are returned to the original form of payment. We cannot issue refunds to alternate cards or accounts.

5. Planning and Concierge Fees

Embark Cruises, LLC reserves the right to charge reasonable planning, research, and concierge fees for services requested above and beyond standard booking assistance. These services may include, but are not limited to, complex itinerary design, extensive revisions, customized planning, or time-intensive consultation. Any applicable fees will be communicated clearly in advance and will only be charged once acknowledged by you.

6. Travel Insurance Disclosure

Embark Cruises, LLC is not an insurance provider or seller of insurance and cannot advise on policy coverage. Purchasing travel insurance is optional and is not required in order to purchase any other products or services offered by Embark Cruises, LLC. You are fully responsible for understanding the coverage of each plan, the terms and conditions of the policies, and for ensuring it meets your individual needs.

Embark Cruises, LLC is not authorized to answer technical questions regarding policy benefits, exclusions, limitations, or conditions, nor can we evaluate the adequacy of coverage or determine whether it overlaps with any insurance you may already have. You are encouraged to compare any travel insurance policy with other insurance coverage you may have to avoid duplicate coverage.

If you have questions regarding policy details, coverage, claims, cancellations, or review periods, you must contact the insurance provider directly. All descriptions of coverage, claim filing procedures, cancellation terms, and insurer contact information are provided by the insurance provider in their marketing and fulfillment materials.

Once travel insurance is purchased, your insurance relationship exists solely between you and the insurance company. Embark Cruises, LLC assumes no responsibility or liability for insurance coverage decisions, claim outcomes, or insurer performance.

7. Cybersecurity and Data Protection

We maintain industry-standard cybersecurity measures designed to protect customer information. However, no system is completely immune from unauthorized access, malware, data breaches, or other cyber incidents. By using our services, you acknowledge and accept these inherent risks. Embark Cruises, LLC shall not be held liable for damages arising from cyber incidents beyond our reasonable control.

8. Customer Responsibility

You agree not to use our systems in any unlawful or harmful manner, including attempts to circumvent security protocols, introduce malicious code, or misuse booking platforms. You are responsible for safeguarding your account credentials and for notifying us immediately of any unauthorized access.

9. Indemnification

You agree to indemnify, defend, and hold harmless Embark Cruises, LLC , its officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, or expenses, including reasonable attorney fees, arising out of or related to your use of our services, your breach of these Terms and Conditions, or any negligence, willful misconduct, or violation of law on your part.

10. Limitation of Liability

To the fullest extent permitted by law, Embark Cruises, LLC’s liability shall be limited and shall not exceed the amount of commission earned on your booking. We are not responsible for the actions, omissions, or failures of third-party travel suppliers.

11. Acceptance of Terms

By completing a booking with Embark Cruises, LLC , you acknowledge that you have read, understood, and agree to these Terms and Conditions in their entirety.
